Terms and Conditions (October 2, 2026)
You have indicated a desire to register for one or more courses from Noise Control Master Class (NCMC) from Nelson Acoustics LLC (NALLC). Your participation signifies your agreement to the following Terms and Conditions.
NCMC consists of live-virtual, instructor-led online training seminars. The information conveyed is based on the experience and opinions of the Presenter for educational purposes only, and do not constitute recommendations.
FEE
The registration fee for each course is indicated on the website at the time of registration or by prior arrangement. Payment must be made in advance and confirms acceptance of the terms and conditions. Your payment will be handled online by a third-party service except by prior arrangement.
PARTICIPATION
Course participation or viewing is restricted to those who have registered and paid. Only registered individuals will receive a Zoom meeting link.
Participation is predicated on appropriate behavior. Disruptive or distracting behavior may result in the Attendee being removed from the meeting at the discretion of the Presenter without recourse.
PROFESSIONAL DEVELOPMENT
If requested, Nelson Acoustics will provide a letter documenting your participation in its Course(s). Nelson Acoustics does not provide accredited PDH units at this time.
CANCELLATION/REFUND POLICY
- Transfer to the same training course at a later date: No fee.
- Cancellation 10 or more days prior: eligible for 90% refund.
- Cancellation 1 to 10 days prior: eligible for 80% refund.
- If class is cancelled by Nelson Acoustics or cannot be delivered for technical reasons: eligible for 100% refund
- Absence by an attendee or cancellation with less than 24 hrs notice is not eligible for a refund.
MEETING LOGISTICS
You will need reliable access to an internet-connected device. The meeting will be conducted using Zoom. Basic familiarity with its functions, as well as general internet skills, are presumed. Check that your device meets its requirements before registering for the course.
INTELLECTUAL PROPERTY
The content of NCMC courses is a product of and copyrighted by NALLC. Neither video or audio recording is allowed without prior approval, nor may the presentation be used for training AI. A copy of the Course slides and other resources will be provided to you. You are authorized to make one physical copy of the slides per Registration. You may make electronic copies on computer devices you control for your personal use. The Course slides are not intended to function independently of Course attendance. Further duplication or distribution is expressly forbidden. Contact NALLC to discuss wider dissemination within your Company.
RECORDING, PHOTOGRAPHY, AND PUBLICITY RELEASE
In connection with in-person and live virtual events associated with NCMC, your image, voice, likeness, and content you post, submit, or share within any NCMC Event may be captured by NALLC for use in future seminars or marketing material. By attending an in-person or live virtual event associated with NCMC, you grant NALLC a worldwide, royalty-free, fully paid-up, transferable, sublicensable, perpetual, and irrevocable license to use, reproduce, edit, distribute, publicly display, and create derivative works (Content) from the Event, in any media now known or later developed, for any purpose, including promotional, marketing, and advertising purposes, without further notice to or approval from you and without compensation to you. This license is granted once, at the time of your participation, and applies to all Content arising from that participation; NALLC is not required to seek your permission again each time it uses such content.
If you do not wish to be recorded, photographed, or have your community content used as described in this Section, please notify NALLC in advance of the applicable event or refrain from attending, going on camera, or participating in said event, or posting in the applicable community feature, as NALLC may not be able to accommodate individual opt-outs once content has been captured or posted.
WARRANTY
Nelson Acoustics LLC’s services are provided on an “as is” basis. Nelson Acoustics LLC disclaims all warranties of any kind, whether express, implied, or statutory, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. Nelson Acoustics LLC makes no warranty that (i) the services will meet your requirements, (ii) the services will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the services will be accurate or reliable, or (iv) the quality of any products, services, information, or other material purchased or obtained by you through the services will meet your expectations.
LIMITATION OF LIABILITY
You expressly understand and agree that NALLC will not be liable for any indirect, incidental, special, consequential, exemplary damages, or damages for loss of profits including but not limited to, damages for loss of goodwill, use, data or other intangible losses (even if NALLC has been advised of the possibility of such damages), whether based on contract, tort, negligence, strict liability or otherwise, resulting from: (i) the use or the inability to use the services; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the services; or (v) any other matter relating to the services. In no event will NALLC’s total liability to you for all damages, losses or causes of action exceed the amount you have paid NALLC in the last six (6) months, or, if greater, one hundred dollars ($100).
